Is At-Home Insemination Legal in New York?

Yes — at-home insemination is fully legal in New York. No state law restricts the act of inseminating at home for personal reproductive use. New York's reproductive rights framework, reinforced by the Reproductive Health Act of 2019, strongly protects personal reproductive decisions. There is no requirement for a physician to be involved in the physical act of insemination.

Donor Sperm Laws in New York

New York Public Health Law Section 4164 governs artificial insemination. Under New York law, when a married woman receives artificial insemination by donor sperm with her husband's consent in writing, the husband is the legal parent of the resulting child. New York's parentage framework has been updated to accommodate same-sex couples and single women under the Child-Parent Security Act (CPSA) enacted in February 2021.
